Hawkeye Service by SJP Immigration Inc. - Terms and Conditions

  1. Engagement: The Hawkeye Service offered by SJP Immigration Inc. is a limited-scope retainer, where the client's application is reviewed comprehensively by a licensed RCIC via screen share. This engagement does not include full representation by SJP Immigration Inc. There is no warranty on outcome, and nobody can guarantee an approval with IRCC.

  2. Payment: Payment for the Hawkeye Service must be made in full prior to the scheduled review time. If payment is not made greater than 24 hours before the scheduled review time, SJP Immigration Inc. reserves the right to cancel the review session.

  3. Product Selection: It is the client's responsibility to select and choose the right product for their application. For Express Entry applications, this means having a valid invitation to apply. For LMIA-based work permit applications, this means being in possession of a valid LMIA. For Visitor Visa applications, this means being eligible to apply for a visitor visa.

  4. Submission Letter: A submission letter will only be granted if the RCIC is satisfied that the application is complete and viable for submission. The times allotted for the following reviews are 1 hour for Visitor Visa, 1.5 hours for Work Permit (LMIA-based only), and 2 hours for Express Entry review. The RCIC may extend these times at their discretion only. It is the client's responsibility to ensure they have compiled a complete application.

  5. Cancellation: The client may cancel or reschedule the review session at least 24 hours prior to the scheduled review time without penalty. Any cancellation or rescheduling made less than 24 hours before the scheduled review time will result in a forfeiture of the Hawkeye Service fee.

  6. Liability: SJP Immigration Inc. will not be held liable for any errors, omissions, or misrepresentations made by the client in their application. It is the client's responsibility to provide accurate and complete information.

  7. Confidentiality: SJP Immigration Inc. will keep all client information confidential and will not disclose it to any third party without the client's written consent, except as required by law.

  8. Limited Scope Retainer Agreement: By purchasing the Hawkeye Service, the client acknowledges and agrees to the terms and conditions set forth in this document and the Limited Scope Retainer Agreement to be signed by the client and SJP Immigration Inc. not longer than 10 days from the date of the scheduled review session.

  9. Customized Hawkeye Service: SJP Immigration Inc. may grant a customized Hawkeye Service for applications that fall outside the scope of the services outlined in these terms and conditions. Any such service will be granted at the discretion of SJP Immigration Inc. and will be subject to a separate agreement between SJP Immigration Inc. and the client. The terms and conditions of such customized Hawkeye Service will be outlined in the separate agreement.
  10. Use of Representative: If the client has a completed application ready for submission in their own GC Key or Permanent Resident portal, and engages in a screen share session with a licensed RCIC for review and recommendations, an IMM 5476 form is recommended to be submitted by the client selecting the two checkboxes for appointing and cancelling a representative. The form must be signed and dated, and a letter outlining the scope of the services provided by the representative should also be included. The client may submit this information, including the IMM 5476 form, through their own portal. The client agrees to inform IRCC via the appropriate methods and use of the signed IMM 5476 form and cancelled IMM 5476 form that the applicant sought guidance from a licensed RCIC but subsequently immediately cancels the authorization. The client also agrees to receive any application updates directly and to use their own contact information for communication with IRCC.
